This website is operated by KULA Recovery LLC, trading as KULA Recovery. Throughout the site, the terms “KULA Recovery”, “we”, “us” and “our” refer to KULA Recovery LLC.
By accessing this website, purchasing from us, requesting a quotation, placing an order, making a payment, booking an installation, or using any of our products or services, you agree to be bound by these Terms of Service, together with any other policies, quotations, invoices, warranty documents, product instructions, installation documents or written terms provided by us.
These Terms apply to all users of the website and all customers of KULA Recovery, including browsers, consumers, businesses, trade customers, commercial customers, resellers, project clients, developers, gyms, hotels, wellness facilities and any other purchaser or user of our products or services.
Please read these Terms carefully before using our website or purchasing from us. If you do not agree to these Terms, you should not use our website, purchase our products, or use our services.
We reserve the right to update, amend or replace these Terms at any time by posting the updated version on our website. It is your responsibility to review these Terms periodically. Your continued use of our website, products or services after any changes are posted constitutes acceptance of those changes.
Our online store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services online.
SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms, you confirm that you are at least the age of majority in your country, state, province or jurisdiction of residence, or that you are the age of majority and have given consent for any minor dependent to use this site.
You may not use our website, products or services for any illegal, unsafe, unauthorized or improper purpose.
You must not transmit viruses, malware, worms, destructive code or any harmful technology through our website or systems.
A breach of these Terms may result in the immediate termination of your access to our website, products or services, without prejudice to any other rights or remedies available to us.
SECTION 2 - GENERAL CONDITIONS
We reserve the right to refuse service, cancel an order, suspend delivery, decline installation, or stop providing services where we have a lawful or reasonable commercial reason to do so. This may include, but is not limited to, non-payment, suspected fraud, misuse of our products, abusive behaviour, unsafe site conditions, unsuitable installation conditions, breach of these Terms, or circumstances outside our reasonable control.
You agree not to reproduce, duplicate, copy, sell, resell, exploit, misuse or reverse engineer any part of our website, service, content, product information, images, designs, brand assets, quotations, pricing, manuals or other materials without our express written consent.
The headings used in these Terms are for convenience only and do not affect the interpretation of these Terms.
SECTION 3 - WEBSITE INFORMATION AND PRODUCT INFORMATION
We aim to ensure that the information on our website is accurate, complete and up to date. However, product information, specifications, pricing, images, colours, dimensions, availability, lead times and descriptions may occasionally contain errors, omissions or changes.
Images, videos and descriptions are provided for general guidance only. Actual products may vary slightly due to model updates, production changes, supplier changes, manufacturing tolerances, accessories, upgrades, installation environment, lighting, screen display settings or customization.
You should not rely solely on website information when making decisions for high-value, commercial, bespoke or site-specific purchases. Where suitability, dimensions, electrical requirements, drainage, access, installation or product performance are important, you must confirm these details with us in writing before placing your order.
We reserve the right to correct errors, update information, amend pricing, change specifications, withdraw products, or cancel orders where information is inaccurate, incomplete or outdated.
SECTION 4 - MODIFICATIONS TO PRODUCTS, SERVICES AND PRICES
Prices for our products and services are subject to change without notice.
We may modify, update, discontinue or replace any product, service, feature, specification, package, offer or promotion at any time.
We shall not be liable to you or to any third party for any modification, price change, suspension, discontinuation, specification update, product replacement, or change in availability.
SECTION 5 - PRODUCTS AND SERVICES
KULA Recovery supplies wellness and recovery products, which may include ice baths, chillers, saunas, contrast therapy products, accessories, filters, covers, steps, spare parts, maintenance services, installation services and related products or services.
Certain products or services may be available exclusively online and may have limited quantities.
We reserve the right to limit the sale of our products or services to any person, business, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.
We reserve the right to limit quantities, refuse orders, cancel orders, or restrict purchases that we believe are unsuitable, unauthorized, fraudulent, high-risk, placed by dealers or resellers, or otherwise inconsistent with our commercial policies.
We do not guarantee that any product or service will meet your expectations, preferences, site conditions or intended purpose unless we have expressly confirmed this in writing.
SECTION 6 - CONSUMER, BUSINESS AND COMMERCIAL CUSTOMERS
Some customers purchase from us as private consumers. Others purchase from us for business, trade, hospitality, gym, wellness, development, project, resale or commercial purposes.
Where products or services are purchased for business, trade, professional, hospitality, gym, wellness, development, project, resale or commercial use, the customer acknowledges that they are purchasing as a business or commercial customer and not as a private consumer, unless applicable law states otherwise.
For business, trade, commercial and project customers, additional terms may apply, including quotation terms, invoice terms, purchase order terms, project terms, payment schedules, delivery conditions, installation requirements, warranty terms and handover documentation.
If there is any conflict between these Terms and a signed written agreement between KULA Recovery LLC and a business, trade, commercial or project customer, the signed written agreement shall prevail to the extent of that conflict.
SECTION 7 - CUSTOM, BESPOKE, BRANDED, IMPORTED AND SPECIAL-ORDER PRODUCTS
Some products may be custom, bespoke, branded, made-to-order, imported-to-order, project-specific, specially reserved, modified, upgraded, configured or sourced specifically for you.
Custom, bespoke, branded, made-to-order, imported-to-order, project-specific, specially reserved or special-order products cannot be cancelled, returned, exchanged or refunded once production, procurement, customization, branding, reservation, import, allocation or preparation has commenced, except where required by applicable law or expressly agreed by us in writing.
This includes, but is not limited to, products ordered in specific colours, finishes, branding, dimensions, configurations, specifications, components, accessories, electrical requirements or project quantities.
Deposits or advance payments for such products may be non-refundable once we have committed costs, reserved stock, placed supplier orders, commenced production, commenced branding, arranged import, allocated goods, or otherwise acted in reliance on the order.
SECTION 8 - ORDERS, PAYMENTS AND DEPOSITS
An order is not accepted or confirmed until approved by us.
We may require full payment, deposit payment, staged payment, cleared funds or written payment confirmation before processing, reserving, importing, manufacturing, customizing, dispatching, delivering or installing any product.
Where a deposit is paid, the deposit secures the order and allows us to commit stock, supplier orders, production time, import arrangements, customization, delivery planning, installation resources or other costs.
Any balance payment must be paid in accordance with the agreed payment terms. We reserve the right to delay or withhold delivery, installation, handover, warranty support, documentation or services until all due amounts have been received in cleared funds.
Late payment, failed payment, chargebacks, payment disputes or non-payment may result in delayed delivery, delayed installation, suspension of service, cancellation of order, removal of installed products where legally permitted, recovery action, legal costs, collection costs and any other remedies available to us.
SECTION 9 - DELIVERY, ACCESS AND INSTALLATION
Delivery and installation dates are estimates unless expressly confirmed by us in writing as fixed dates.
We will make reasonable efforts to meet estimated delivery and installation timelines, but we are not liable for delays caused by suppliers, shipping, customs, authorities, weather, force majeure events, customer readiness, access issues, building restrictions, third-party contractors, payment delays, site conditions or circumstances outside our reasonable control.
The customer is responsible for ensuring that the delivery and installation location is ready, safe, accessible and suitable before the scheduled delivery or installation date.
This includes, where applicable:
(a) suitable access for vehicles, delivery teams and equipment;
(b) suitable parking, loading, unloading and site access;
(c) lift access, stair access, doorway access and corridor clearance;
(d) any building, landlord, community, developer, facilities management or authority approvals;
(e) suitable flooring, structural support and surface level;
(f) suitable electrical supply, sockets, isolators, breakers and cabling;
(g) suitable water supply, drainage and ventilation;
(h) shade, cover or weather protection where required;
(i) suitable space around the product for access, ventilation, servicing and maintenance;
(j) removal of obstacles or hazards; and
(k) any permissions required to complete delivery or installation.
If delivery or installation cannot be completed due to customer-related issues, unsafe conditions, lack of access, lack of approvals, site not being ready, incorrect measurements, unsuitable electrical supply, unsuitable drainage, unsuitable ventilation, restricted parking, or any other issue outside our control, we may charge additional fees for re-delivery, re-installation, waiting time, storage, additional labour, specialist equipment, third-party contractors or cancelled attendance.
We reserve the right to refuse, delay, reschedule or stop installation where we believe the site is unsafe, unsuitable, inaccessible, non-compliant, not ready, or likely to damage the product or create risk.
Unless expressly agreed in writing, we are not responsible for civil works, plumbing works, electrical works, drainage works, flooring works, structural works, authority approvals, building management approvals, craneage, specialist lifting, waterproofing, ventilation works or other site preparation.
Risk in the products may pass to the customer upon delivery, installation, collection, handover or attempted delivery where delay is caused by the customer.
You must inspect products upon delivery or installation and notify us promptly in writing of any visible damage, missing items, installation concerns or defects.
SECTION 10 - SITE SUITABILITY AND CUSTOMER RESPONSIBILITIES
You are responsible for ensuring that the product is suitable for your intended location, use, environment and site conditions.
This includes checking product dimensions, access routes, electrical requirements, ventilation needs, drainage requirements, operating environment, water source, maintenance access, and any building restrictions.
We may provide guidance, but unless we have carried out a formal site survey and confirmed suitability in writing, any guidance is general only.
You are responsible for obtaining all approvals, permissions and consents required for installation or use, including from landlords, property owners, developers, building management, facilities management, community management, authorities, insurers or other relevant parties.
You are responsible for ensuring that our products are not installed or used in a way that causes nuisance, leakage, flooding, overheating, electrical issues, structural issues, damage to property, injury, or breach of any building or community rules.
SECTION 11 - WATER QUALITY, MAINTENANCE AND OPERATING CONDITIONS
Correct maintenance is essential for the performance, safety and lifespan of our products.
You are responsible for maintaining suitable water quality, cleaning filters, replacing consumables, keeping water balanced, maintaining adequate water flow, ensuring correct ventilation, protecting the product from unsuitable environmental conditions, and following all operating and maintenance instructions provided by us.
Failure to maintain the product correctly may cause damage, poor performance, unpleasant odours, contamination, leaks, corrosion, freezing, overheating, pump failure, chiller failure, electrical issues or health and safety risks.
Warranty cover may be reduced, refused or voided where damage, failure or performance issues are caused by or connected to:
(a) poor water quality or poor water chemistry;
(b) incorrect use of chlorine, salt, bromine, chemicals, oils or cleaning products;
(c) dirty, blocked, missing or overdue filters;
(d) lack of cleaning, servicing or maintenance;
(e) restricted water flow;
(f) running the product without sufficient water;
(g) poor ventilation or restricted airflow;
(h) overheating or unsuitable ambient temperature;
(i) outdoor exposure beyond the product’s intended rating;
(j) direct sun, rain, sand, dust, humidity, flooding or environmental damage;
(k) incorrect electrical supply or power fluctuations;
(l) misuse, neglect, accidental damage or abnormal use;
(m) unauthorized repairs, alterations, modifications or movement;
(n) installation, disconnection or relocation by anyone other than us or our authorized representatives; or
(o) failure to follow product instructions, maintenance guidance or reasonable advice provided by us.
You should keep records of maintenance, filter changes, servicing, water treatment and any issues reported to us, especially for commercial, gym, hospitality or shared-use products.
SECTION 12 - HEALTH AND SAFETY DISCLAIMER
Our products are wellness and recovery products. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease, illness, injury or medical condition.
Cold water immersion, sauna use, heat exposure and contrast therapy may carry health risks and may not be suitable for everyone.
You should seek medical advice before using our products if you are pregnant, elderly, under 18, have a heart condition, blood pressure condition, circulation issue, respiratory condition, neurological condition, diabetes, epilepsy, fainting history, immune condition, skin condition, are taking medication, have recently had surgery, are recovering from illness or injury, or have any medical concerns.
You must not use our products while under the influence of alcohol, drugs, medication or any substance that may impair judgment, physical ability, reaction time or awareness.
You must stop using the product immediately if you feel dizzy, faint, breathless, unwell, numb, confused, excessively cold, overheated, in pain, or otherwise uncomfortable.
Children, vulnerable persons, inexperienced users and guests must be supervised appropriately. You are responsible for anyone who uses the product with your permission or at your premises.
Commercial, gym, hospitality, wellness and shared-use customers are responsible for carrying out their own risk assessments, user screening, supervision, operating procedures, cleaning processes, signage, staff training and emergency procedures.
You use our products at your own risk, except where liability cannot lawfully be excluded or limited.
SECTION 13 - RETURNS, REFUNDS, EXCHANGES AND CANCELLATIONS
Returns, refunds, exchanges and cancellations are governed by our Return Policy, these Terms, and applicable law.
Products may not be eligible for return, refund or exchange where they have been used, installed, customized, specially ordered, imported to order, made to order, damaged after delivery, affected by misuse, affected by poor maintenance, affected by unsuitable water quality, affected by unsuitable site conditions, or altered by the customer or any third party, except where required by applicable law.
Approved refunds will be processed in accordance with our Return Policy or as otherwise confirmed by us in writing.
Delivery charges, installation charges, collection charges, payment processing fees, finance provider fees, customization costs, import costs, packaging costs, handling costs, site visit charges, bank charges or other incurred costs may be deducted from any refund where permitted by law.
Where an order is cancelled after we have incurred costs, committed stock, placed supplier orders, booked installation resources, arranged delivery, imported goods, customized products, or otherwise acted in reliance on the order, we reserve the right to deduct reasonable costs from any refund, subject to applicable law.
SECTION 14 - WARRANTIES
Product warranties are governed by our applicable Warranty Policy, supplier warranty terms, product-specific warranty document, invoice terms, or written warranty confirmation provided with the product or order.
Warranty coverage may vary by product, component, model, supplier, installation type, use case, environment and customer type.
Warranty coverage may be conditional on correct installation, correct use, suitable water quality, regular cleaning, filter replacement, servicing, suitable electrical supply, suitable ventilation, suitable drainage, suitable environment and compliance with all instructions provided by us.
Warranty does not cover, unless expressly stated otherwise in writing:
(a) general wear and tear;
(b) consumables, filters, cartridges, seals, accessories or replaceable parts;
(c) cosmetic deterioration, fading, staining, scratches or marks;
(d) damage caused by poor water chemistry or incorrect chemical use;
(e) damage caused by blocked filters or poor maintenance;
(f) damage caused by misuse, neglect, abuse or accidental damage;
(g) damage caused by unauthorized repairs, movement, alteration or modification;
(h) damage caused by third-party installation, relocation or disconnection;
(i) damage caused by unsuitable site conditions;
(j) damage caused by incorrect electrical supply, power surges or power fluctuations;
(k) damage caused by environmental exposure, rain, flooding, sand, dust, humidity, direct sun or heat;
(l) damage caused by use outside the product’s intended purpose;
(m) commercial overuse where the product was purchased for domestic use;
(n) faults not reported within a reasonable time;
(o) consequential losses, loss of income, loss of use, loss of business or replacement facility costs; or
(p) any issue excluded by the applicable warranty document.
We may require photographs, videos, maintenance records, proof of purchase, serial numbers, site information, water quality information, inspection access or return of parts before approving any warranty claim.
Where no fault is found, or where the issue is caused by customer misuse, lack of maintenance, site conditions or excluded causes, call-out fees, inspection fees, repair fees, replacement parts, delivery charges or labour charges may apply.
SECTION 15 - COMMERCIAL, GYM, HOSPITALITY AND SHARED-USE CUSTOMERS
Where products are used in gyms, hotels, spas, wellness centres, recovery centres, residential developments, offices, sports facilities, commercial premises or any shared-use environment, the customer is responsible for ensuring safe operation, supervision, maintenance, cleaning, hygiene, risk management and compliance with all applicable laws, regulations and industry requirements.
Commercial and shared-use customers are responsible for ensuring that products are appropriate for the intensity and frequency of use.
Products purchased for domestic or private use may not be suitable for commercial or high-frequency use. Warranty coverage may be affected if a domestic-use product is used in a commercial or shared-use environment.
Commercial customers must ensure that staff are trained, users are informed, safety warnings are displayed, cleaning and water treatment processes are followed, and the product is used only in a safe and appropriate manner.
SECTION 16 - THIRD-PARTY CONTRACTORS, SUPPLIERS AND SERVICES
We may use third-party suppliers, delivery providers, contractors, installers, payment providers, finance providers, technology providers or service partners in connection with our products and services.
We are not responsible for third-party delays, third-party platforms, third-party websites, third-party payment issues, finance provider decisions, building management decisions, authority approvals, customs delays, supplier delays or contractor delays outside our reasonable control.
Where third-party products, services, links, tools or platforms are made available through our website or as part of our service, your use of those third-party products or services may be subject to their own terms and conditions.
SECTION 17 - OPTIONAL TOOLS AND THIRD-PARTY LINKS
We may provide access to third-party tools, applications, integrations, websites or resources over which we do not have control.
You acknowledge and agree that such tools and links are provided “as is” and “as available” without warranties, representations or endorsements.
We are not liable for any harm, loss or damage related to your use of third-party tools, links, platforms, services, products or websites.
You should review third-party policies and terms carefully before using them or engaging in any transaction.
SECTION 18 - USER COMMENTS, REVIEWS, PHOTOS AND SUBMISSIONS
If you send, upload, tag, post, provide or share reviews, comments, testimonials, photographs, videos, feedback, suggestions, ideas or other materials relating to KULA Recovery, our products or our services, you agree that we may use, reproduce, edit, publish, share, distribute and display such materials for business, marketing, training, customer service and promotional purposes, unless you expressly tell us otherwise in writing.
You confirm that any materials you provide do not infringe the rights of any third party and that you have the right to provide them to us.
We may monitor, edit or remove content that we consider unlawful, offensive, misleading, defamatory, infringing, abusive, obscene or otherwise inappropriate.
You must not use a false identity, mislead us or others, post unlawful content, upload harmful code, or submit content that infringes the rights of any third party.
SECTION 19 - PERSONAL INFORMATION
Your submission of personal information through the website, store, forms, WhatsApp, email, payment platforms or other channels is governed by our Privacy Policy.
By using our website, placing an order or contacting us, you agree that we may process your personal information as reasonably required to respond to enquiries, process orders, arrange delivery, arrange installation, provide support, process payments, manage warranty claims, comply with legal obligations and operate our business.
SECTION 20 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally, there may be information on our website, quotations, invoices, product pages, marketing materials, messages or other communications that contains typographical errors, inaccuracies or omissions.
These may relate to product descriptions, dimensions, pricing, promotions, offers, shipping charges, transit times, availability, images, specifications, stock levels, warranty information or other details.
We reserve the right to correct errors, inaccuracies or omissions, change or update information, cancel orders, amend quotations, or refuse fulfilment if information is inaccurate at any time, including after an order has been submitted.
SECTION 21 - PROHIBITED USES
You are prohibited from using our website, products, services, content or brand:
(a) for any unlawful purpose;
(b) to violate any law, regulation, rule or ordinance;
(c) to infringe our intellectual property rights or the rights of others;

Products are supplied subject to the applicable product specifications, warranty terms and written order terms. You are responsible for ensuring that the product is suitable for your intended purpose, site and use case before purchase.
Nothing in these Terms excludes or limits any warranty, right or remedy that cannot legally be excluded or limited under applicable law.
SECTION 23 - LIMITATION OF LIABILITY
To the maximum extent permitted by law, KULA Recovery LLC, its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers and licensors shall not be liable for any indirect, incidental, punitive, special or consequential loss or damage.
This includes, without limitation, loss of profits, loss of revenue, loss of savings, loss of data, loss of use, business interruption, loss of goodwill, replacement facility costs, downtime, inconvenience, wasted expenditure, or any similar damages arising from your use of our website, products or services.
For business, trade, commercial and project customers, our total aggregate liability shall, to the maximum extent permitted by law, be limited to the amount actually paid by the customer for the specific product or service giving rise to the claim.
We are not liable for damage, loss, injury, defect, delay or failure caused by misuse, lack of maintenance, poor water quality, unsuitable site conditions, incorrect installation by third parties, unauthorized repairs, electrical issues, drainage issues, customer negligence, third-party contractors, building management restrictions, environmental exposure, or failure to follow instructions.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
SECTION 24 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless KULA Recovery LLC, its directors, officers, employees, affiliates, agents, contractors, suppliers, subcontractors, service providers and licensors from any claim, demand, loss, damage, cost, liability or expense, including reasonable legal fees, arising out of or relating to:
(a) your breach of these Terms;
(b) your misuse of our website, products or services;
(c) your failure to follow product instructions or safety guidance;
(d) your failure to maintain products correctly;
(e) unsuitable site conditions;
(f) third-party use of products at your premises;
(g) your violation of any law or regulation;
(h) your infringement of any third-party rights; or
(i) any claim brought by your guests, users, staff, customers, tenants, residents, members, contractors or third parties, except to the extent caused by our proven breach of applicable law.
SECTION 25 - FORCE MAJEURE
We shall not be liable for any delay, failure, loss or damage caused by events outside our reasonable control.
This may include, but is not limited to, supplier delays, shipping delays, customs delays, port delays, border delays, acts of God, extreme weather, flooding, fire, war, conflict, civil unrest, labour disputes, epidemics, pandemics, transport disruption, authority action, import restrictions, power failures, internet failures, payment provider issues, material shortages or any other event beyond our reasonable control.
SECTION 26 - SEVERABILITY
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law.
Any unenforceable portion shall be deemed severed from these Terms, and the remaining provisions shall remain valid and enforceable.
SECTION 27 - TERMINATION
These Terms remain effective unless terminated by either you or us.
You may terminate these Terms by ceasing to use our website, products and services, subject to any outstanding payment obligations, warranty terms, order terms or other liabilities already incurred.
We may terminate or suspend your access to our website, services, support, delivery, installation or warranty assistance where you breach these Terms, fail to pay amounts due, misuse products, act unlawfully, abuse our staff, provide false information, or create unsafe or unsuitable conditions.
Termination does not affect any obligations or liabilities incurred before the termination date.
SECTION 28 - ENTIRE AGREEMENT
These Terms, together with any policies, quotations, invoices, warranty documents, product instructions, installation documents, handover documents or written agreements provided by us, constitute the entire agreement between you and KULA Recovery LLC in relation to your use of our website, products and services.
These Terms supersede any prior or contemporaneous communications, discussions, proposals or agreements, whether oral or written, except where a separate written agreement has been signed by KULA Recovery LLC.
Any failure by us to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
SECTION 29 - GOVERNING LAW AND JURISDICTION
These Terms and any separate agreements whereby we provide products or services to you shall be governed by and construed in accordance with the laws of the United Arab Emirates.
The courts and competent authorities of the United Arab Emirates shall have jurisdiction, unless otherwise required by applicable law or agreed by us in a signed written agreement.
